It is mutually agreed that the following terms of the agreement form an integral part of this contract and that no variation or modification of this contract shall be effective unless accepted by both Images by Marko and the client, in writing.

Booking Deposit
A booking fee of £500 is required at the time of booking, along with the signed contract. Dates can only be reserved once the deposit has been paid. Images by Marko accept cash, cheque, credit or debit card as forms of payment. Cheques should be made payable to Images by Marko.

Balance Payment
The balance of payment must be made no late than 30 days prior to the agreed wedding ceremony. Additional prints/albums/frames must be paid for at the time of ordering.

Fees
Fees are dependant on the Collection selected by the client. All Collection fees include the booking deposit. Each Collection includes a full day's photographic coverage and proofs or photographs on the website gallery.

Licence
Images by Marko will be granted creative and artistic licence in relation to poses photographed and locations used,. The photographer's judgment in relation to photographic style and number of photographs taken shall be deemed correct.

Viewing Photographs
images by Marko use 2 methods of photograph viewing.

1. A mutually convenient appointment can be made whereby images are viewed.
2. Images can be viewed using the the password protected, online proofing facility.
Photograph selection for the album(s) must be made within 6 months of the wedding ceremony. Selection after this 6 month period may result in an additional charge.

Copyright
The 1998 Copyright, Designs and Patents Act assigns copyright to Images by Marko. Photographs taken under this contract may not be copied in any way. Images by Marko will store a copy of photographs taken for 6 years but cannot accept liability for loss of images during this period.

Images by Marko retain the right to use photographs in future marketing material. The client's permission will be attained where deemed applicable.

Exclusivity
Images by Marko shall be the sole professional photographers at the venues specified.

Force Majeure
In the unlikely event of photographic failure, injury or sickness beyond Images by Marko's control, liability shall be limited to a full refund of all monies paid. Your statutory rights are not affected.

Insurance and Accreditation
Images by Marko have full public liability insurance and Personal Indemnity Insurance. Images by Marko are a member of the British Institute of Professional Photography and the Master Photographers Association.

Cancellation
If Images by Marko have to cancel this contract for reasons beyond its control, its liability shall be limited to a full refund of monies paid. If the client cancels the contact (after 14 days unconditional refund period), the following compensation charges will apply as a percentage of the total fee.
60 days (before the ceremony) or less - 100%
61 - 90 days - 75%
91 - 120 days - 50%

If the cancellation turns out to be a postponement, then subject to the photographer's availability, all monies paid may be applied to the new ceremony. In this instance, total fees chargeable at that time will apply.

Complaints
In the unlikely event of an unresolved complaint, the client may request the MPA or the BIPP to act as independant conciliators; their recommendations will be accepted as final

Privacy
Images by Marko will store your name and wedding details on an internal database. These details will not be made available to companies or individuals external to Images by Marko. Should you wish for your details to be removed, please inform us in writing.
